1. Acceptance of Terms

By accessing or using Nokkh AI's website, APIs, and services (collectively, the "Services"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our Services.

2. Description of Services

Nokkh provides Nokkh AI-powered tools for the fashion industry including:

• Virtual Try-On: Enables e-commerce customers to visualize garments on themselves using Nokkh AI-generated imagery.
• Nokkh AI Model Photography: Generates studio-quality product photos using Nokkh AI models from garment flat-lay images.
• API Access: Programmatic access to our rendering engine for integration into third-party platforms.

3. Account Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use.

4. Acceptable Use

You agree not to:

• Upload content that is illegal, harmful, threatening, abusive, or infringes on any third party's rights.
• Use the Services to generate deceptive, misleading, or fraudulent imagery.
• Reverse-engineer, decompile, or attempt to extract the source code of our Nokkh AI models.
• Exceed your plan's usage limits or circumvent rate limiting.
• Resell, sublicense, or redistribute our Services without written consent.

5. Intellectual Property

Your Content: You retain ownership of all images you upload. By uploading content, you grant Nokkh a limited, non-exclusive license to process your images solely for the purpose of delivering the Services.

Generated Outputs: Nokkh AI-generated images produced by our platform are owned by you under your active subscription. You may use them commercially in accordance with your plan.

Our IP: All Nokkh technology, algorithms, models, trademarks, and platform design remain our exclusive property.

6. Subscription & Billing

• Paid plans are billed monthly or annually at the rates displayed at the time of purchase.
• All fees are non-refundable unless otherwise stated or required by law.
• We reserve the right to change pricing with 30 days' notice. Existing subscriptions will be honored until their current billing period ends.
• Unused Nokkh AI generation credits do not roll over between billing periods.

7. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We may perform scheduled maintenance with advance notice. We are not liable for downtime caused by factors beyond our control (e.g., third-party outages, force majeure).

8. Limitation of Liability

To the maximum extent permitted by law, Nokkh shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

9. Termination

Either party may terminate the agreement at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Services ceases immediately. We will retain your data for 30 days post-termination, after which it will be permanently deleted.

10. Governing Law

These Terms are governed by the laws of the jurisdiction in which Nokkh AI is incorporated. Any disputes shall be resolved through binding arbitration.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or an in-app notification at least 30 days before taking effect. Continued use of the Services after changes constitutes acceptance.
